These Terms of Use ("Terms") constitute a legally binding agreement between you and BARREL ARBITRAZH ("Company," "we," "us," or "our") governing your access to and use of the Nexium: Secure VPN & Proxy iOS application ("the App").
You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices you own or control, solely for personal, non-commercial purposes.
You agree to use Nexium only for lawful purposes. You must not use the App to:
Nexium may offer free and paid subscription tiers. All purchases are processed by Apple through the App Store and are governed by Apple's terms and conditions. We do not store payment card information. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period through your Apple ID account settings.
Refunds are governed by Apple's refund policy. We have no ability to issue refunds for App Store purchases.
All content, trademarks, logos, and software included in or made available through the App are the property of BARREL ARBITRAZH or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses.
To the maximum extent permitted by applicable law, BARREL ARBITRAZH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profit, arising out of or in connection with your use of the App.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
The App may contain links to or integrate with third-party services. We are not responsible for the content, privacy practices, or availability of such services. Your use of third-party services is at your own risk.
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, if we believe you have violated these Terms or applicable law.
These Terms are governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date. Your continued use of the App following such changes constitutes acceptance of the revised Terms.
